BUSINESS LAW: Pre-employmenttests mustbe lawful (The Times of Northwest Indiana)
Employers may ask applicants to describe or demonstrate how they would perform job tasks, so long as all applicants in the job category are asked to do so and so long as the test is consistent with business necessity. In particular, employers must be sure that pre-employment tests do not have an unlawful disparate impact on individuals in a protected class, including female applicants.
